Client Eligibility and Account Security

Age Requirement: Clients must be 21 years of age or older to engage our services. We do not provide services to minors under any circumstances.

Account Confidentiality: Clients are responsible for maintaining absolute confidentiality of their account credentials and booking information. CE maintains the highest standards of discretion and expects the same from our clientele.

Documentation: Clients must retain copies of all transaction records, booking confirmations, and these Terms and Conditions for their records.

Limitations of Liability

Independent Contractors: CE curates and arranges luxury experiences through a carefully vetted network of premium independent contractors, including private aviation companies, luxury hotels, Michelin-starred restaurants, private estates, yacht charters, and specialized service providers. These entities operate independently, and CE serves as a facilitator of these exceptional services.

Scope of Responsibility: While CE exercises the highest standards in vetting partners and ensuring quality, we cannot be held liable for:

  • Acts of God, force majeure, or extraordinary circumstances beyond reasonable control
  • Political instability, terrorism, or civil unrest in destination countries
  • Weather-related delays or cancellations affecting private aviation or marine vessels
  • Mechanical failures of luxury transportation or equipment
  • Health emergencies or medical incidents during experiences
  • Changes in government regulations affecting travel or activities
  • Overbooking or service modifications by third-party luxury providers
  • Personal injury or property damage during activities, regardless of cause

High-Risk Activities: Many exclusive experiences involve inherent risks, including but not limited to:

  • Private aviation and helicopter transfers
  • Yacht charters and marine activities
  • Alpine skiing and mountaineering expeditions
  • Safari and wildlife encounters
  • Extreme sports and adventure activities
  • Access to remote or challenging locations
  • Cultural immersions in developing regions

Risk Assumption and Indemnification

Voluntary Participation: By engaging CE’s services, clients acknowledge they are voluntarily participating in luxury experiences that may involve inherent risks of injury, illness, or in extreme cases, death. Clients assume full responsibility for their personal safety and well-being.

Medical Considerations: Clients must disclose any medical conditions that could affect their participation in planned activities. CE reserves the right to require medical clearance for certain high-risk experiences.

Release of Liability: Clients release CE, its officers, employees, agents, and affiliates from any claims arising from participation in arranged experiences, except in cases of gross negligence, willful misconduct, or fraudulent behavior by CE.

Indemnification: Clients agree to indemnify CE against any third-party claims arising from their participation in experiences or any actions taken during their engagement with our services.

Cancellation and Refund Policy

Premium Service Commitment: Given the bespoke nature of our services and the exclusive arrangements made on clients’ behalf, our refund policy reflects the significant commitments required to secure luxury experiences.

Refund Eligibility: Refunds are considered only for:

  • Verifiable medical emergencies with appropriate documentation
  • Force majeure events preventing travel or participation
  • Service failures directly attributable to CE’s gross negligence
  • Cancellation by CE due to safety concerns

Claims Process: All refund requests must be submitted in writing within 14 days of the affected experience, accompanied by comprehensive documentation. Claims submitted after 30 days will not be considered.

Partial Refunds: Adjustments are calculated based on actual costs incurred and services that can be cancelled without penalty. No refunds are provided for:

  • Unused portions of partially completed experiences
  • Changes in personal circumstances
  • Dissatisfaction with subjective elements of experiences
  • Last-minute cancellations due to personal choice

Privacy and Discretion

Photography and Media: CE may document experiences for quality assurance and marketing purposes, with absolute respect for client privacy. Clients who prefer complete anonymity must notify CE at booking. All marketing materials will be subject to client approval when featuring identifiable individuals.

Confidentiality: CE maintains strict confidentiality regarding all client information, travel patterns, and personal preferences. Our team operates under comprehensive non-disclosure agreements.

Data Protection: Client information is protected according to the highest international data protection standards, with secure storage and limited access protocols.

Terms Modification and Communication

Amendment Rights: CE reserves the right to modify these Terms and Conditions to reflect changes in regulations, service offerings, or operational requirements. Material changes will be communicated to active clients with reasonable notice.

Acceptance: Continued use of CE services following any amendments constitutes acceptance of revised terms.

Effective Date: These Terms and Conditions become effective immediately upon booking confirmation and payment processing.
